Terms of Use
Version: terms-of-use-v1 · Jurisdiction: South Africa · Locale: en-ZA · Last updated: 22 August 2026 · Effective: 22 August 2026
These Terms of Use (the Terms) govern access to and use of the WhatAnEvent website, organiser dashboard, participant application flows, ticket checkout, ticket delivery, gate-scanning services, and related features (together, the Platform).
Please read these Terms carefully. By creating an account, joining an organisation, publishing or operating an event, submitting an application, buying or using a ticket, scanning a ticket, or otherwise using the Platform, you agree to these Terms. If you act for a company, club, promoter, or other person, you confirm that you have authority to bind them.
1. About WhatAnEvent
The Platform is operated by WhatAnEvent (Pty) Ltd ("WhatAnEvent", "we", "us", or "our") in South Africa.
WhatAnEvent provides software and operational tools that help organisers publish and manage events, receive participant applications, build programmes or lineups, sell and deliver tickets, communicate with users, and validate entry. Unless we expressly say otherwise, the event organiser creates and runs the event and is responsible for the venue, programme, safety, staffing, permissions, licences, rules, advertised offering, and fulfilment of the event.
2. Other terms that apply
The following documents also apply where relevant:
- Our Privacy Policy, which explains how personal information is handled.
- Our Refund Policy, which applies to ticket cancellations, postponements, and refund requests.
- Our Guest Checkout Terms, which supplement these Terms when a ticket order is placed without an account.
- Event-specific descriptions, entry conditions, age restrictions, venue rules, waivers, rulesets, and organiser notices displayed during the relevant flow.
If event-specific terms conflict with these Terms on a matter controlled by WhatAnEvent, these Terms apply. If they concern the organiser's event operations, the organiser's clearly disclosed terms apply, subject always to applicable law and any non-excludable consumer rights.
3. Eligibility and authority
You must have legal capacity to agree to these Terms. Host and scanner accounts are intended for people aged 18 or older, unless WhatAnEvent expressly approves another arrangement.
Participants or attendees under 18 may use public event flows only where the event permits it and a parent, guardian, or other competent person provides any authority or consent required by law and the organiser. A ticket does not override an event's lawful age restriction.
You may only provide another person's information, invite them to a team, apply or act for them, or buy a ticket for them if you are authorised to do so.
4. Accounts and access
You must provide accurate, current information and keep it up to date. You are responsible for safeguarding your password, email account, devices, session links, invitation links, order-lookup links, ticket links, and QR codes.
Accounts and permissions are personal to the authorised user. You must not share credentials or let an unauthorised person use your role. Organisation owners are responsible for assigning appropriate team and scanner access, reviewing membership, and removing access that is no longer required.
Tell us promptly at support@whatanevent.app if you suspect unauthorised access, a compromised ticket or link, or misuse of your account. We may require verification before restoring access or disclosing account information.
5. Organiser responsibilities
An organiser using the Platform must:
- Provide accurate event, venue, pricing, ticket, participant, refund, age, safety, accessibility, and entry information.
- Have the authority, permissions, licences, insurance, venue arrangements, personnel, and approvals needed to advertise and operate the event.
- Use participant and buyer information only for legitimate event operations and in accordance with applicable privacy, consumer, marketing, safety, and communications laws.
- Request only participant information reasonably necessary for the event and obtain any consent or guardian authority required for minors or special personal information.
- Honour valid tickets, advertised inclusions, lawful refunds, and commitments made to participants and buyers.
- Manage event safety, participant suitability, waivers, rulesets, medical or regulatory requirements, venue controls, and emergency arrangements.
- Keep team permissions, payout identifiers, event status, capacity, inventory, and operational information accurate.
- Respond reasonably and promptly to participant, buyer, refund, payment, and access issues.
WhatAnEvent may ask for evidence that an organiser is authorised and prepared to operate an event. We may delay publication, sales, settlement, or access where reasonably necessary to investigate fraud, safety, legal, payment, or platform-integrity concerns.
6. Participant applications
Submitting an application does not guarantee acceptance, a place in a programme or lineup, payment, travel, accommodation, or participation. The organiser decides whether to review, approve, reject, withdraw, reserve, or assign an applicant, subject to applicable law and any disclosed event rules.
You must provide accurate information relevant to safe and fair participation. You must not misrepresent your identity, age, experience, affiliation, eligibility, health clearance, record, or authority to participate.
Some events require acceptance of a waiver or ruleset. Read those documents carefully. WhatAnEvent does not provide medical, legal, coaching, matchmaking, or safety advice, and the Platform's administrative tools do not determine whether a person is medically or competitively fit to participate.
7. Tickets, payments, and entry
Ticket prices, quantities, service fees, currency, and material conditions are shown during checkout. Payment is processed through the displayed payment provider. An order is not complete merely because payment was attempted; confirmation depends on successful provider verification and issuance of the ticket.
Each QR ticket is a revocable credential for the event and ticket type shown. You must keep it secure. A ticket may be rejected if it is invalid, duplicated, refunded, voided, fraudulently obtained, already checked in, or used contrary to disclosed event rules.
The organiser controls venue admission and may lawfully refuse entry or remove a person for safety, capacity, age, intoxication, prohibited conduct, invalid credentials, or breach of event or venue rules. Refusal or removal does not automatically create a refund right; the Refund Policy, disclosed event terms, and applicable consumer law govern.
Unless the Platform expressly supports authorised transfer or resale, you must not reproduce, tamper with, sell above face value, or commercially resell a ticket or QR code. Contact support if a ticket is lost, compromised, or delivered to an incorrect destination.
8. Fees, settlement, refunds, and disputes
Fees payable by a ticket buyer are disclosed before purchase. Commercial fees and settlement arrangements applicable to an organiser may be set out in a separate order form, written agreement, or the organiser dashboard.
Organisers are responsible for accurate payout setup and for any taxes, levies, permits, or charges arising from their event or proceeds, unless a written agreement says otherwise. We may withhold or delay settlement where a payment is pending, reversed, disputed, suspected to be fraudulent, subject to a refund, or where information reasonably required for settlement is missing.
Refund eligibility is described in the Refund Policy and may also be affected by event-specific terms and non-excludable consumer law. Before initiating a payment dispute or chargeback, contact support@whatanevent.app so the issue can be investigated. Nothing in these Terms removes a lawful right to approach a payment provider or consumer-protection body.
9. Communications
By providing contact details and choosing a communication channel, you authorise operational messages reasonably necessary for your account, application, order, ticket, refund, security, or event changes, subject to the notice and consent presented in the relevant flow.
Promotional messages or broader promotional use require the justification or optional consent stated when you opt in. You may withdraw optional consent using the method in the message or by contacting us. You are responsible for providing a reachable phone number or email address and checking ticket and event information before arrival.
Delivery through WhatsApp, email, mobile networks, and other third-party services is not guaranteed. A delayed message does not invalidate an otherwise available ticket or order record. Use the order-lookup or support process where available to recover a ticket.
10. Your content
You retain ownership of content you submit, including event descriptions, logos, photographs, participant profiles, messages, comments, and other materials (User Content).
You grant WhatAnEvent a non-exclusive, worldwide, royalty-free licence to host, copy, process, adapt for technical formatting, display, transmit, and distribute User Content only as reasonably necessary to operate, secure, support, and promote the relevant Platform feature or event, and to comply with law. This licence ends when the content is deleted from active systems, except for lawful retention, backups, audit evidence, and content already used with valid promotional permission.
You confirm that you have the rights and permissions needed to submit User Content and that it does not infringe privacy, publicity, confidentiality, intellectual-property, or other rights. Do not upload unlawful, misleading, defamatory, discriminatory, exploitative, abusive, or malicious content.
We may remove or restrict User Content where we reasonably believe it violates these Terms, applicable law, another person's rights, event safety, or Platform integrity. Where practical and lawful, we will notify the affected account.
11. Acceptable use
You must not:
- Break the law, facilitate unlawful activity, or use the Platform for a fraudulent, unsafe, deceptive, or unauthorised event or transaction.
- Impersonate another person, misrepresent authority, create false applications or orders, or manipulate availability, payments, refunds, votes, applications, scans, or audit records.
- Share or harvest private contact details, send spam, or use personal information outside the purpose for which it was provided.
- Circumvent permissions, security controls, rate limits, QR protections, payment checks, or event access restrictions.
- Probe, scan, reverse-engineer, scrape, overload, disrupt, introduce malicious code into, or gain unauthorised access to the Platform, except to the extent a restriction cannot lawfully apply.
- Use the Platform or its content to build a competing dataset or service without our written permission.
- Abuse, threaten, harass, discriminate against, exploit, or endanger participants, attendees, organisers, staff, or other users.
We may investigate suspected misuse and preserve or disclose relevant records where permitted or required by law.
12. Intellectual property
WhatAnEvent and its licensors own the Platform software, design, documentation, trade marks, branding, and other materials we provide, excluding User Content and organiser-owned branding. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Platform for its intended purpose.
No rights are granted to copy, sell, license, distribute, reverse-engineer, or create derivative works from the Platform except where these Terms or applicable law expressly permit it.
13. Third-party services
The Platform relies on third-party services for payments, messaging, email, hosting, storage, maps, wallets, and other functions. Their own terms and privacy notices may apply to your use of those services.
We are not responsible for a third party's independent acts, content, systems, or availability. We will, however, take reasonable steps within our control to investigate and recover from provider failures affecting a Platform transaction.
14. Availability and changes
We aim to keep the Platform reliable and accessible, but do not guarantee uninterrupted, error-free, or permanently available service. Maintenance, security incidents, provider outages, network failures, force majeure, or urgent operational work may interrupt access.
We may add, change, suspend, or retire features. We will take reasonable steps to avoid materially disrupting active paid events and to communicate material changes where practical. Beta, preview, or test features may be changed or withdrawn and should not be relied on for critical operations unless we expressly agree otherwise.
Organisers must maintain reasonable operational fallbacks for event day, including access to essential attendee, ticket, and safety information where appropriate.
15. Suspension and termination
You may stop using the Platform at any time. Account or organisation deletion may be subject to verification, outstanding transactions, disputes, lawful retention, and owner-authority checks.
We may restrict, suspend, or terminate access where reasonably necessary because of a material breach, fraud, non-payment, a security or safety risk, unlawful activity, abuse, a provider or legal requirement, or conduct that threatens users or Platform integrity. Where the circumstances allow, we will give notice and a reasonable opportunity to remedy the issue.
Terms that by their nature should survive termination will continue to apply, including payment obligations, intellectual-property provisions, disclaimers, liability provisions, dispute terms, and lawful record retention.
16. Disclaimers
To the extent permitted by law, the Platform is provided on an "as available" basis. We do not warrant that every event will proceed, every applicant will be accepted, every ticket will be delivered through a preferred channel, or every organiser, participant, venue, supplier, or attendee will perform as promised.
WhatAnEvent is not the event organiser, venue operator, promoter, sanctioning body, medical provider, security provider, insurer, coach, matchmaker, travel provider, or employer unless expressly identified as such for a specific event. Organisers remain responsible for event delivery, safety, suitability decisions, permissions, and compliance.
Nothing in these Terms excludes an express Platform commitment or a warranty, right, or remedy that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 or other applicable law.
17. Limitation of liability
Nothing in these Terms limits liability that cannot lawfully be limited, including liability arising from fraud, wilful misconduct, or another non-excludable legal obligation.
To the fullest extent permitted by law, WhatAnEvent is not liable for indirect, incidental, special, punitive, or consequential loss, or for loss of profit, revenue, opportunity, goodwill, or anticipated savings, arising from use of the Platform.
To the fullest extent permitted by law, WhatAnEvent's total aggregate liability arising from a particular event or occurrence will not exceed the greater of the fees paid to WhatAnEvent by the claimant for the affected Platform service during the 12 months before the event giving rise to the claim or R1,000. This cap does not reduce any non-excludable consumer right or refund obligation.
18. Organiser indemnity
To the extent permitted by law, an organiser agrees to indemnify WhatAnEvent and its personnel against third-party claims, losses, penalties, and reasonable costs arising from the organiser's event operations, User Content, unlawful data use, breach of these Terms, breach of event commitments, or failure to obtain required permissions, licences, consents, insurance, or authority, except to the extent caused by WhatAnEvent's own unlawful conduct, negligence, or breach.
This section does not apply to an individual consumer to the extent it would unlawfully waive or limit a protected right.
19. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa.
Before starting formal proceedings, please send a written description of the dispute to support@whatanevent.app. The parties should first try in good faith to resolve the dispute through direct discussion. This does not prevent either party from seeking urgent relief, using a payment-provider dispute process, or approaching a regulator, ombud, consumer body, or court where entitled to do so.
The parties submit to the jurisdiction of the South African courts that have lawful authority over the dispute.
20. General
If a provision of these Terms is unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue.
Our failure to enforce a provision is not a waiver. You may not transfer your account or rights under these Terms without our written consent. We may transfer our rights and obligations as part of a bona fide restructuring, financing, merger, or sale, subject to applicable law.
These Terms, together with the documents incorporated in section 2 and any separate written commercial agreement, form the agreement governing the relevant use of the Platform. A separately signed agreement prevails over these Terms to the extent of a direct conflict for the subject it covers.
21. Changes to these Terms
We may update these Terms to reflect changes to the Platform, providers, risk, or applicable requirements. We will publish the new version and effective date. For material changes, we will take reasonable steps to notify affected users and request fresh acceptance where required.
